Purpose and Reason:

This amended rule provides guidance around pre-existing past due child support paid by a noncustodial parent for a child receiving RIW benefits, for the period of time that the family was not in receipt of RIW benefits, to be paid to the family in which the child resides. Appropriate households may retain the past due amount as an amount owed to them personally. Any such payment to the household will be treated as Lump Sum Income, if it is in excess of the allowed monthly pass through amount. This rule further reflects technical revisions throughout to comply with current State and Federal Law, and enhancements to internal procedures on program operation. This amendment was implemented via emergency rule-making in October 2009.
